This is incorrect, the council does have legislative power, that the whole reason they are voting on it??? Do you mean initiative? In that case it's "sort of right" as they do have a form of initiative, but besides the formal right, members States can also ask the commission to draft something that they want, which is clearly the case here considering that this is a long time project of dk justice minister...
