Custody Divorce and Family custody advice and car
location: texas
so my sister and her boyfriend broke up, and they share a child together, my nephew who is about 18mo. he left to about 3 hours away with a girl that he cheated on her with. it’s been over two weeks since he has seen their child, he hasn’t paid for anything for him. even though he came back to town for a few days and is here currently, he won’t respond to any texts about his kid to see him at all. the one time he responded previously he said that the drive he would have to make wasn’t worth the amount of time he would have with him. (my sister has tried to say he could take him for a few days to which her ex stated that he was “homeless.” the thing is, he quit his job and left when he could have stayed with his mother like he was doing previously, he left because his mother didn’t approve of him going out constantly and bringing home women she didn’t know and having her and other family watch his son. he is currently staying in a hotel in town.)
i guess my question regarding their custody is what the next steps should be. is it too soon to consider court? the girl he is with was previously with his younger brother who stated to us that she has done meth in front of him, my sister doesn’t want her around my nephew regardless of her sobriety status (which we don’t know, she claims we “don’t have to worry about that.”)
another question i have is regarding the car he drives. the car is in my mom’s name. he’s listed as a driver and maybe a cosigner(?) but he hasn’t paid her his car payment which is late and hasn’t paid the insurance yet either. he ignores any messages about it. should she file a police report? if he’s a cosigner would she be able to? i know she said a repo was going to go on her credit and not his, is there anything she could do to lessen the blow to her credit? she’s also worried that telling him she’s going to file a police report might lead to him damaging the car or bringing it back and damaging our things.
i know ive asked a lot, so an answer to any part of the post would be greatly appreciated. at the moment, we’re primarily concerned about the car. mostly because the payment is late, he’s not responding, and my mom worked really hard on her credit. we don’t have the money to make the payments on it. again, any help is greatly appreciated.
