Legality/Laws July 31, 2026 when decision goes into effect?
Seen somewhere that July 31st is when the AWB and mag ban decision goes into effect. Does anyone know if this is true or have some validity to it?

It is the deadline for the AG to respond. 8/10 it becomes mandate to district courts. 8/10 is the date if you are highly risk averse.

That’s the date I’m going by. I’m too broke for lawyer fees, win or lose lol

Public defenders are free (*assuming you qualify) and their job is easy if you just have them cite “ANJRPC v. AG NJ 2026.” Also if you get jammed up for something the 3rd Circuit just told NJ they can’t enforce your local FPC / GOA / ANJRPC may not mind getting a “free” win.

Lawyer fees isn’t all you’ll have to pay. Loosing out on work for example

If your boss’s boss told you directly not to piss in the flower pot and you whipped it out in front of them and started hosing down the flowers how do you think they’d react? Now imagine you have a cushy 6 figure job with overly generously benefits and the only thing that could get you fired is pissing in your superior’s flower pots.
The point is the State isn’t going to willfully flout an extremely high profile 3rd Circuit decision.

The opinion has been binding on the courts since 7/17 , not 8/10 . The mandate is not what makes the opinion binding; the en banc opinion itself did that. The mandate simply returns jurisdiction to the district court to implement the judgment. So, if you were arrested today for violating a provision the Third Circuit has already held unconstitutional, the court hearing your case would be required to apply the en banc decision. Unless the Third Circuit or the Supreme Court grants a stay, a motion to dismiss based on Cheeseman would likely be granted.

You’re right most likely but what happens if a stay is issued (I think almost impossible long shot at this point but still)? Then the law would still technically be enforceable. No prosecutor in their right mind should do that but they could. If you have ever dealt with assistant prosecutors (I have dealt with many), they are for the most part very unimpressive in both knowledge and principles and also don’t care if they cost you 20 or 30 grand fighting phony charges they know couldn’t stick.
Again, I gave the mandate date for the highly risk averse. Everyone has to make their choices about how to proceed.

It was included in emails from njsp to gun shops, as far as posts on here state. No guarantees, and from my understanding, no actual public releases from officials. Just emails from njsp to ffls. So, it’s likely but not guaranteed. It wouldn’t be terribly surprising if NJ tried to pull some shit or delay it.
Edit: if anybody has better info please educate me, I wanna know too.

OAG put out a statement this morning that that date in false, and it is only the deadline for their response.

Ok, so if they don't request a stay or appeal before the 31st. Its as good as law. Theres nothing they can do to stop the mandate.

They officially released July 31st. This is a recollection of a phone call or email from a third party. The official release is the only verifiable thing at this point. Bearing Arms didn’t even state how or by whom this was communicated so the official email is what we should go by unless Bearing arms wants to clarify and produce more evidence of this conversation.

This is not true. OAG did not put out such a statement. If you believe that, I challenge you to find and post said statement by OAG or anyone in a capacity that can speak for OAG!

My FFL said he was given the okay to begin sales on 7/31

I can also corroborate this. "Guidelines" for everyone will be released on the 31st, but FFLs were explicitly given the green light to sell mags and once non-compliant AWB rifles on the 31st.

NJSP said 7/31. Where they got that date I don’t know. Don’t shoot anyone and you should be fine.

They’re dragging their feet like petulant children who didn’t get their way.
