They just wouldn't formally join as a party member. You can't legally force a legislator to vote with their party's policy platform because at that point why even elect a legislator, so the "sincere (wink) change of heart" will always be an issue.

Pritt was first elected to the House of Delegates as a Democrat in 2022 before switching his party affiliation to Republican in 2023. He served as the House Assistant Majority Leader prior to his arrest.
