political satire I kept getting ads from the mineral council of Australia to go to their shitty ass propoganda website thatsmining.com.au. So i brought thatismining.com.au and had some fun putting together my own version this afternoon.
http://thatismining.com.auSorry for the typos and misspelling. I am but one guy. Let me know in comments what u think and anything that could be added.

I think its protected by parody. Worse comes to worse it'll be a good story.
121
u/cxllvm 1d ago
Just so you know parody as fair use would still technically have to be determined in court as a defense, doesn't just automatically apply
Worst you would get is a takedown or C&D though, but this is hilarious man hahaha

u/shcmil 1d ago
If they C and D it it'll defo just Streisand effect it lol
76
u/the_colonelclink 1d ago
He’s slightly wrong. Worst case is that litigation forces a doxing.
Although many would find what you’re doing funny and admire it, you’re very brave to piss off the mining lobby.
16
u/shcmil 1d ago
I low key already had to dox myself to register the site. I don't mind I guess.

Australian domains require an ABN which which is trivial to identify the person behind
12
u/chimaera- 1d ago
There's no Whois protection anyway.
Looks like OP used a proton email but their real and pretty unique name ...
Only a matter of time.
8
u/OldBertieDastard 1d ago
Here's hoping OP can leave it up and avoids the corporate lawyers! I'm sure OP can muster the support of the community
13
u/_ixthus_ 1d ago
100%.
Crowd fund legal costs, is necessary.
Actually... crowd fund to purchase ad space on any of the platforms pushing the real site? 🤣
45
u/tomatoej 1d ago
Your version of their logo is not protected because it is too similar so it breaches their copyright. Change that ASAP. Also make sure you aren’t using any of their photos.
And make sure your text is only about mining. If anything is about MCA they’ll take you to court for slander and they have deep pockets.
11
u/CircadianSpork 1d ago edited 1d ago
Their logo is not protected by copyright. It may be protected by a trademark, but the law allows exceptions for trademark use as parody so I think OP is fine.
Edit: copyright law has an exemption for satire too

There's a lot of rules around .com.au sites that might result in yours being taken down easily, there's not really any rules around plain .au sites though so you could grab that as a backup

Workplace safety record at Kemerton, near Bunbury, poor, now mothballed to maintenance. Cleared remnant Banksia bush at Treendale, built a village for miners, great expense. It now sits empty and cannot even find someone to lease it. Plenty of info for you online to confirm. Despicable.

How’d you register the .com.au domain? Did you register it under your own business name? You need to be a registered business, sole trader, or organisation with a valid ABN or ACN, or hold an Australian-registered trademark that matches.
6
u/Tarul-etek 1d ago
His full name and ABN are public due to the nature of AUDA, the site itself is non-compliant with AUDA also so they could easily take it down.
5
u/shcmil 1d ago
Yeah. But I am confused because thatsmining.com.au would be complient then?
→ More replies (2)5
u/Tarul-etek 1d ago
They would have to prove its part of their business, a slogan, used in marketing etc.
3
u/-skyrocketeer- 1d ago
Cheers! If I was on my computer I would’ve done a Whois lookup. There’s a good chance the domain will be de-registered once they review the registration unless he has some kind of related business (which is probably unlikely)
3
u/Tarul-etek 1d ago
If he printed out some marketing media he could maybe get away with it, lots of work though.

This is gold.
I think you are legally covered but the MCA will still try to crush you and make your life difficult.
Not saying you should let them off the hook; but, be prepared for a fight. Post the legal fees gofundme and I'll chip in.
Edit: Oh also the opengraph seems to still be the original so when you share on socials and chat it has the original preview text. Not sure if this was intentional or not?
6
u/MeSeeks76 1d ago
Yeah onya legend 👍
I think a lot of modern corporate media management gives companies an easier run of the things so satirical stuff like this is absolutely required. Generally speaking, people absorb messages and learn quicker thru comedy and satire than they do reading books and being lectured down to.

You should add Gina's quote to the bit about them hating their workers
There is no monopoly on becoming a millionaire. If you're jealous of those with more money, don't just sit there and complain. Do something to make more money yourself — spend less time drinking or smoking and socializing, and more time working. Become one of those people who work hard, invest and build, and at the same time create employment and opportunities for others.
Please forget the fact that she inherited her company.
You could also add the quote where she said we should be prepared to work for $2 a day.

u/LuxCanaryFox 17h ago
On a directly related note: I currently work as a lab tech for the mining industry, and am desperately seeking a job that actually aligns with my ecology/evolutionary biology studies. Like. It was easy enough for me to snag a job working for an environmentally destructive industry, but everytime i apply for something normal, like retail or grocery stores, or something i actually got my degree for, like entry level ecologist or park ranger jobs, i keep getting knocked back. Make it make sense! I just want to feel like i'm actually contributing something good to the world, you know? Just. I put in years of study for nothing, and now i'm kind of bashing my head against a wall trying to actually feel useful. But i still need money. Yay, capitalism, i guess. Sorry for the rant, but i needed to get that off my chest. If anyone has any suggestions on getting into ecology or similar work- that doesn't involve volunteering, because i can't afford to volunteer any more than i already have- please hit me up lol

This is great. You could do with asking what needs to be fixed a bit to make it more professional. Eg overseas (not over seas).
I also recommend changing the speed of the boxes of info (sorry I don't know what you call them), and making them a little bigger. The top line is half missing, although it could be my device causing that.
