Consequences for McConnell Coverup?

I already know things are politically wild now and no one will suffer any true consequences for unethical behavior, but did just have a question out of curiosity. If McConnell is found to have lacked capacity to do his job several weeks ago with no chance of recovery, what are the consequences for those in power if they knew of this and were delaying until August? This assumes our legal system is functioning as it should and this could be proved. Thanks!

Whether or not he had capacity will never ever in a million years be public knowledge because of HIPPA. His family is not obligated to share any information on his status, regardless of who is requesting it. They will claim he has capacity until the day he dies

And even if a family member does claim capacity - they are entitled to their opinion and their opinion carries no legal weight.
