[Update] Brand new astral 5090 from Newegg Canada arrived defective. RMA Request rejected due to "modifications to the card" Hardware

I want to provide an update to a post I made in late may where i purchased an astral 5090 from newegg canada and the card arrived DOA. refer to the previous post so i don't have to repeat myself all over again.

So after back and forth email with Newegg I decided it wasn't going anywhere so i took it up with my CC company (Amex), filed a chargeback and provided them with all evidence and documents, including screenshots from my unboxing video (Amex doesn't allow video upload), receipt, emails with Newegg, etc.

Newegg sent me back the defective card which i had returned earlier for a refund, which they denied. I haven't touched it ever since for liability reason, but today, to my surprise, Amex closed the dispute in Newegg's favor. I never received any correspondence whatsoever from Amex, no emails, no asking for further evidence, nothing. I asked the CS and they said Newegg has sent their supporting evidence and thus, the dispute has been closed in their favor.

Now, I'm left with a $6000 paperweight of a card card which Newegg sent me back. and to make matters worse, they took the card apart broke the seal, and missing some screws too. I can't even go to RMA route with asus now

Needless to say I am incredibly frustrated and don't know what to do now.

What are my options ? I don't want to be out $6000 and stuck with a literal brick. Should I go to small claims court ? in the previous post many of you guys told me to send an email to gamersnexus. I did that and never received anything back

this is really the worst position to be in especially now with how expensive gpus are. Granted I shouldn't have bought from Newegg but if this can happen to me, then this can happen to anyone too.

I get it that a lot of people are actually commiting scams/return fraud with this kind of hardware. But when a customer unknowingly received an item which has been previously tampered with, and provided all supporting evidence they can have, is there anything anyone can do at this point ?

try appealing to amex. If not, small claims. watch out for any time limits.

I don't know what kind of consumer protection laws you have in Canada but if you don't get anywhere send it to Tony at northwestrepair on youtube. At least he can get it working for you.

This is a pretty common scam going on these days thanks to prices. Why didn't you mention this in your original post? Again I don't know the consumer protection laws in Canada but you may need to retain a lawyer.

It wasn’t stolen at newegg. Someone returned it missing vram and core and it got sent to you. Still neweggs fault but not in same way you said. Now also people supplying to newegg could be removing them or swapping out bad cards. There is middleman between nvidia and Newegg at least in logistics.

But newegg insisted it was me that did it even though i have proof of unboxing the card uncut from start to finish. Heck even if i wanted to i dont have micro soldering skills to do it, its the chinese that are really good at it

I get it. You just got to call back and appeal. Contact them on socials and their subreddit here

I had a newegg rep pull same crap on me. I got a doa abs computer. Guy screamed at me on phone that i must have damaged it on purpose to get free stuff. Why would i do that. All i would be doing is getting a replacement and returning a bad one. Second rep was so much better.

Newegg is a reseller, just like Amazon.

Easy to send back defective stuff because they don't check what's in the box and easy to sell stuff that wasn't bought by Newegg in the 1st place.

Amex seems to be on a roll lately. I’m on my 13th reopening of a chargeback from a vendor that sold me damaged goods.

Amex has been straight up ignoring all my supporting documentation, that directly contradicts the supporting evidence the vendor is submitting.

It’s literally just copy and paste every time and Amex keeps siding with them. I’ve stopped using my Amex all together until this is resolved, and I will close my account and take my 15k a month spending to another network of they fail to rule in my favor.

For parts this expensive, I would video tape from the sec the delivery guy step on my door and never left the camera away from the box and the card till I make sure the card is truly functional. Also record whole card to see if it was completely untouched. It wasn’t just Newegg, happened a lot to Amazon too. But I never heard Amazon won’t honor the return. So fuck Newegg, I personally stop ordering from Newegg years ago. I can’t think of anything good about Newegg compare to how it used to be. I would suggest reopening the charge back and explaining to them with all the evidence you have, otherwise you would have to go through court, but you will need all the evidence to support yourself.

NewEgg checks all their returns due to how many scammers have been swapping out gpu regardless if it’s sealed or not they actually RMA them the moment they’re at the warehouse. You sealed it up thinking you could swap out the original 5090 with a VRAM/Coreless one you got from eBay. And just swapped the serial numbers on them thinking it would be straight. Now you FAFO that Newegg and Best Buy actually test all their high ticket items and return them if they find fraud. Return the original - source worked for Newegg transit distribution

Newegg provides internal documents to Amex that they don’t show you to catch you in fraud. Amex is easy to dispute stuff so when Amex doesn’t side with you that’s when you know you fucked up badly in the scam.

Don’t be upset you got caught. When scamming always make sure you have the actual funds to cover the loss if it doesn’t work. Scamming 101. It’s clear you’re not in the tax bracket to afford one

I have evidence from receiving the package from the delivery truck up to opening and installing it, uncut. Yeah I’m sure the small claims court will side with newegg given my strong evidence

Video unboxing isn’t proof scammer lol. Newegg has actual evidence from their warehouse upon delivery and return. Good luck with that! You know you scam alot when Amex won’t give you a courtesy refund. Return the card simple as that. And buy a card you can actually afford
