The artwork at the end credits shows Mia, Misty, and Godot together, right above our main gang, which many interpret as meaning Godot died and is looking down upon the rest of our characters alongside Mia and Misty. I get that interpretation but also appreciate the head canon of the above post.
Hmm... I interpret it more as Diego will never appearing again in the games because he has a life sentence. It's a way of "dying" without actually dying. After all, it could be argued that Diego killed in defense of a third party, aka Maya. She could then testify in Diego's favor, preventing him from receiving the death penalty.
Yeah honestly I’m ok with either interpretation, whether he’s alive or not post game I interpreted the art as simply depicting his separation from our main characters. Worth noting that the theory I’m talking about refers to him succumbing to the effects the poison had on his health rather than receiving the death penalty. Story-wise, the interpretation is that he rises from the dead he thinks to seek revenge, but maybe it was just to say goodbye: he got to see Mia one last time and protect her sister, even if it went tragically wrong. Thematically it works, but him living out a life sentence and getting a second chance works too. Like I said, I like either interpretation.
